Terms of Use

Terms governing access to and use of the BuildingCare property-management and building-operations platform.

Please read these Terms carefully. By creating an account, accepting these Terms electronically, or accessing or using BuildingCare, you agree to these Terms to the extent applicable to your role. If you use BuildingCare on behalf of an organization, you confirm that you are authorized to act for that organization.

1. Operator

BuildingCare is operated by Adliya Business Center Co. W.L.L., Kingdom of Bahrain (“ABC”, “BuildingCare”, “we”, “us”). These Terms apply to the BuildingCare website, portals and related services unless a separate written agreement expressly governs a particular customer or service.

2. BuildingCare Service

BuildingCare is a property-management and building-operations platform. Depending on enabled features and user permissions, it may support property hierarchy, tenant and tenancy administration, complaints and maintenance, workers and contractors, rent and payment records, EWA/utilities, assets, notices, visitors, documents, reports and role-based operational workflows.

BuildingCare is a software and record-management service. Unless expressly agreed otherwise, ABC does not become the landlord, property manager, maintenance contractor, payment institution, utility provider, security provider or legal representative merely because the platform is used.

3. Accounts, Roles and Authority

Users must provide accurate information, use only accounts they are authorized to use and keep login credentials confidential. Accounts are personal to the authorized user unless the platform expressly provides otherwise.

Organizations are responsible for appointing administrators and assigning suitable roles and permissions to their personnel. A user acting for a company represents that the user has authority appropriate to the actions performed through the account.

4. Responsibilities of Landlords and Property-Management Customers

A customer using BuildingCare to manage properties is responsible for its own property-management decisions and legal obligations, including where applicable:

  • having lawful authority to manage the relevant property and user relationships;
  • ensuring personal data entered into BuildingCare is collected and processed lawfully;
  • providing required notices and obtaining consent where consent is the applicable legal basis;
  • maintaining accurate tenancy, rent, utility, visitor, worker and contractor records;
  • assigning appropriate user roles and removing access when no longer required;
  • reviewing and authorizing financial, maintenance, visitor and operational actions taken by its personnel;
  • complying with applicable tenancy, property, employment, tax, accounting, safety, consumer and data-protection requirements; and
  • not instructing ABC to process data or perform an action that would violate applicable law.

5. User Responsibilities

Users must use BuildingCare lawfully and only for legitimate property-management or authorized service purposes. Information and documents submitted should be accurate to the user’s knowledge. Users must promptly report suspected account compromise and must not share credentials, impersonate another person, bypass permissions or access records unrelated to their authorized role.

6. Customer Data, Personal Data and Privacy

As between ABC and the customer, the customer retains its rights in data and documents it lawfully provides to BuildingCare, subject to the rights necessary for ABC to host, process, secure, back up, transmit and otherwise handle that data to provide the service and comply with law.

The respective data-protection roles depend on who determines the purposes and means of processing. A landlord/property-management customer may act as Data Controller for tenant, tenancy, maintenance, visitor and related operational data, while ABC may act as Data Processor/service provider for such data. ABC may act as Data Controller for processing for which ABC independently determines the purpose and means, including certain platform-account, security, support and administration activities.

Use of personal data is also governed by the BuildingCare Privacy Policy. Where required, ABC and business customers should maintain appropriate written data-processing terms consistent with applicable Bahrain law.

7. BuildingCare Intellectual Property

BuildingCare software, interfaces, workflows, designs, branding, documentation, databases as structured by the platform, and related intellectual property are owned by or licensed to ABC, except for customer content and third-party materials.

Subject to these Terms and any applicable commercial agreement, ABC grants authorized users a limited, non-exclusive, non-transferable, revocable right to access and use BuildingCare for its intended business purpose. No source code, ownership right or intellectual-property title is transferred.

8. Prohibited Use

You must not:

  • use BuildingCare unlawfully, fraudulently or to harm another person;
  • upload data you are not authorized to process;
  • attempt unauthorized access to another organization, property, account or record;
  • circumvent security, role or permission controls;
  • introduce malware or interfere with service integrity;
  • reverse engineer, copy or exploit the platform except to the extent a restriction is prohibited by applicable law;
  • scrape or systematically extract platform data without authorization;
  • use another user’s credentials or permit unauthorized persons to use your account; or
  • use the service to store content that is unlawful or unrelated to legitimate property operations.

9. Workers, Contractors and Third-Party Services

BuildingCare may enable customers or tenants to record, assign, contact or interact with workers, contractors or other service providers. Unless ABC expressly contracts to provide the underlying service, those providers remain independent third parties. Listing, availability or use through BuildingCare does not by itself constitute an ABC guarantee of price, workmanship, licensing, insurance, availability or suitability.

Any future rewards, discounts, merchant benefits or third-party offers will be subject to the relevant provider’s terms and any additional BuildingCare terms displayed for that program.

10. Fees, Trials and Commercial Terms

Fees, unit pricing, trial periods, implementation arrangements and payment terms are those stated in the customer’s quotation, order, subscription, invoice or other written commercial agreement with ABC. Unless expressly stated in that agreement, promotional or trial access does not create a right to continued free service.

Taxes, including VAT where applicable, may be added as required by law or the relevant commercial agreement.

11. Availability, Maintenance and Service Changes

ABC aims to provide a reliable service but does not promise uninterrupted or error-free availability. Access may be affected by maintenance, updates, telecommunications, cloud infrastructure, cybersecurity events, third-party services, force majeure or other circumstances.

ABC may update, improve, add, modify or retire features where reasonably necessary. Material changes affecting a paid customer’s contracted service will be handled in accordance with the applicable commercial agreement.

12. Suspension and Termination

ABC may suspend or restrict access where reasonably necessary to protect security, prevent unlawful or unauthorized use, respond to non-payment, comply with law or protect BuildingCare, customers or Data Subjects. Where practicable and appropriate, ABC will provide notice.

Termination rights, notice periods, export/return of customer data and post-termination retention are governed by the applicable customer agreement, the Privacy Policy, data-processing obligations and applicable law. Users whose authority ends must stop using the service immediately.

13. Important Service and Liability Provisions

BuildingCare assists users in organizing and managing property operations. Decisions concerning tenants, rent, payments, maintenance, contractors, access, safety, legal compliance and property management remain the responsibility of the relevant authorized person or organization.

To the maximum extent permitted by applicable law, ABC is not responsible for loss caused by inaccurate customer/user data, unauthorized credential sharing, customer decisions, third-party contractor performance, external telecommunications or services, or use of BuildingCare contrary to these Terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the laws of the Kingdom of Bahrain. Any specific financial liability cap agreed with a business customer should be stated in that customer’s written commercial agreement rather than assumed from these public Terms.

14. Responsibility for Misuse

Each organization is responsible for the acts of users it authorizes to use BuildingCare within the scope of their employment, engagement or delegated access, subject to applicable law. A customer may be responsible for losses, claims or regulatory consequences resulting from its unlawful instructions, unauthorized data, misuse of the platform or breach of its contractual obligations.

15. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Bahrain. Subject to any mandatory law or different dispute mechanism expressly agreed in writing, disputes arising from these Terms or use of BuildingCare shall be subject to the competent courts of the Kingdom of Bahrain.

Before commencing proceedings, the parties are encouraged, where appropriate, to attempt in good faith to resolve a business dispute through written notice and reasonable discussion.

16. Changes to These Terms

ABC may update these Terms to reflect changes in BuildingCare, law, security requirements or commercial operation. The version and effective date will be displayed on this page. Where a change materially affects existing contractual rights, the applicable customer agreement and law will determine how that change takes effect.
